Refund Policy
This Refund Policy applies to purchases of evvnly Plus made on our website or in the evvnly web app. evvnly is operated by Rather Active - Unipessoal, Lda (Portugal, NIPC 517304198). You can reach us at hello@ratheractive.tech. For how Paddle and we handle your personal data, see our Privacy Policy; your overall use of evvnly is governed by our Terms of Service.
1. Who processes your payment
Web purchases are processed by our reseller Paddle (Paddle.com Market Limited and its affiliates), acting as Merchant of Record. Paddle is the seller of record for those orders and handles checkout, invoicing, applicable taxes (such as VAT), and refund payouts. Refunds are returned to the original payment method by Paddle; the charge on your statement may appear as Paddle.
Purchases made through a third-party app store (such as the Apple App Store or Google Play) follow that store’s refund process instead of this policy.
2. Your 14-day right of withdrawal
If you are a consumer in the EU/EEA or UK, you have the right to withdraw from a distance purchase within 14 days without giving a reason. Plus activates as soon as you buy it, so the checkout asks you to expressly request that it start immediately and to acknowledge how this affects your withdrawal right. This means:
- If, at checkout, you expressly asked us to start Plus immediately and acknowledged that this affects your withdrawal right, we may keep an amount proportionate to the Plus access you have already used; otherwise we refund you in full.
- In practice, for purchases where you have made little or no use of Plus features, we simply refund in full.
- Once the service has been fully performed (for example, a Trip Pass whose 30-day window has ended), the right of withdrawal no longer applies.
Nothing in this policy limits the statutory rights you have under the consumer law that applies to you — for EU/EEA consumers, EU and Portuguese consumer law, and for UK consumers, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and the Consumer Rights Act 2015.
3. Subscriptions (monthly and annual)
- You can cancel anytime; cancellation stops the next renewal, and Plus stays active until the end of the period you have paid for. Cancelling does not by itself trigger a refund for the current period.
- First purchase: if you ask for a refund within 14 days of starting a paid subscription, we will refund you in full.
- Renewals: if a renewal goes through that you did not intend, contact us within 14 days of the charge and we will refund the renewal provided the new period has seen no meaningful use.
4. Trip Pass
A Trip Pass is a one-time purchase that gives one group Plus features for 30 days. It does not renew.
- You can withdraw within 14 days of purchase. If you expressly asked us to activate the Trip Pass immediately, we may keep an amount proportionate to the access the group has already had; once the 30-day window has fully elapsed, the right of withdrawal no longer applies. Separately from your statutory rights, we will also consider a goodwill refund case by case, even after meaningful group use.
- When a Trip Pass is refunded, Plus features end immediately for the whole group.
5. How to request a refund
Either works — whichever is easier for you:
- Reply to your Paddle receipt email or use the link in it (fastest, goes straight to the Merchant of Record), or
- Email us at hello@ratheractive.tech with the email used at checkout and the approximate purchase date, and we will arrange the refund with Paddle.
Where you exercise your withdrawal right, we (through Paddle) reimburse you to your original payment method without undue delay and within 14 days of being informed, as required by EU law. Your bank may then take a further 5–10 business days to show the funds.
6. Language versions
This Refund Policy is available in several languages. The English version is the original version and prevails in the event of any discrepancy between language versions, unless the mandatory consumer-protection law of your country of habitual residence provides otherwise.
